Do You Need a Permit for a Fence or Gate in Houston?
City of Houston, Harris County, Montgomery County and HOA rules for fences and driveway gates, explained in plain English by a local fabricator.
It depends on where the fence is going. Here is the version we give customers every week. This is general guidance from doing the work, not legal advice, and rules change, so confirm with your city or HOA before you build.
Inside the City of Houston
The city generally requires a permit for fences over 8 feet, and any fence in a front setback has height limits. Most residential side and back fences at 6 feet do not need a permit, but a tall front fence or a driveway gate with columns can. The city also has rules about fences near street corners so drivers can see. If your job is inside city limits we build to the code and tell you when a permit applies.
Unincorporated Harris County and Montgomery County
Outside city limits, including most of Magnolia, Tomball and the acreage around Conroe, there is usually no county fence permit for residential fences. What you still have to respect: property lines, easements and utility lines. Call 811 before we dig, we do that on every job.
Inside a city like Tomball, Conroe or Katy
Each city has its own ordinance. Some require a simple permit for any new fence, some only over a certain height. We have built in all of them and we will tell you what your city wants.
The Woodlands
Different animal. Almost every exterior change goes through Development Standards or your village association first. They look at height, material, color and how far from the street. The good news: a clean dark steel fence or gate is usually an easy approval when the application includes a drawing and a finish spec. We provide both.
HOAs everywhere
Bridgeland, Cinco Ranch, Gleannloch Farms, Cross Creek Ranch, you name it. Most master-planned communities require architectural review for a new fence, gate or visible railing. Typical turnaround is two to four weeks. Submit before you schedule the install, not after.
Electrical for gate openers
A hardwired gate opener may require an electrical permit inside city limits. Solar openers usually avoid that.
